These general conditions govern access and use of the website www.dataestur.es which SEGITTUR makes available, free of charge, to Internet users, and to the information relating to any of the products and services contained therein. Access to this website implies full acceptance, without exception, of each and every provision included in this Legal Notice, in the version published by SEGITTUR at the time of access to the Portal by the User. As a consequence, the User should read this Legal Notice carefully each time he/she wishes to use the Portal, given that it could undergo modifications.
The use of specific services offered at this website is furthermore regulated by the specific conditions governing each particular case, which may substitute, complete and/or modify the current Legal Notice. Therefore before using these services, the User must also carefully read the special conditions applying, which will be deemed as having been accepted merely by the use of the services.
In the same way, use of the Web Portal is subject to all notices, conditions of use and instructions made known to the User by SEGITTUR, which may substitute, complete and/or modify this Legal Notice.
The viewing, printing and downloading of the website content is permitted.
SEGITTUR reserves the right to modify and update the information contained on its web site, also the configuration and presentation and conditions of access, at any time and without prior notice.
SEGITTUR does not guarantee that access to the web will be free from interruptions or errors in content, nor that it will be updated, although it will strive to avoid, repair and update as required.
Intellectual and Industrial Property
All brands, trade names and distinctive signs of any kind appearing on the Portal are subject to the intellectual and industrial property rights of SEGITTUR or of third-parties, without the use of or access to the Portal and/or services entitling the User to any rights over the aforesaid brands, trade names and/or distinctive signs.
The content, understood to include and not limited to the texts, photographs, databases, graphics, audiovisual content, source code, software, etc., is subject to the intellectual and industrial property rights of SEGITTUR or of third-parties. This Legal Notice does not cede to the User any right of exploitation which exists or may exist over such content other than that strictly necessary for the correct use of the Portal and services.
Access by the User of the content and services on the Portal in no case implies any type of surrender, transfer or assignment, in full or in part, of the above rights, nor does it confer any right of use, modification, exploitation, reproduction, distribution or public communication over the content or distinctive marks subject to intellectual or industrial property rights, without prior express authorisation, specifically granted for the purpose by SEGITTUR, or the third party owning the rights.
Conditions for access to and use of the portal
The services offered by SEGITTUR on the Portal are, as a rule, and unless otherwise stated, free of charge. Nevertheless, some of the services offered by third parties via the Portal may be subject to payment, in which case the conditions established by the third party in question for services rendered will be applied.
Access to services rendered via the Web Portal does not require, in general, prior subscription or registration by Users, notwithstanding the fact that for access to certain services, prior registration on the part of the User is indeed required.
The User agrees to use the content and services available through the Web Portal in accordance with these General Conditions and the Specific Conditions established for certain services, and also in accordance with that specified by the Law, moral conduct, good customs and public order.
The User undertakes to respect the intellectual and industrial property rights of SEGITTUR and/or third-parties.
– Provenance and reliability of the information.
SEGITTUR has created this website to provide Users with access to information and content relating to tourism in Spain, from multiple sources. SEGITTUR has obtained the information and materials included on the website from official sources and from others considered to be reliable. However, although reasonable measures have been taken to ensure that the information contained is correct, SEGITTUR does not guarantee that it is correct, complete or up to date. SEGITTUR expressly denies any responsibility for error or omission in the information contained on the pages of this Website.
Third parties are responsible for guaranteeing that the material provided for inclusion in this Portal meets applicable Spanish or overseas legal requirements. SEGITTUR expressly denies all responsibility for any error, omission or incorrectness in the material, errors in interpretation, and any loss, disappointment, negligence or damage that may occur from having relied on the material.
– Obligations for correct use of the Portal, its services and its content.
The User agrees to use the Web Portal and services in accordance with the law, this Legal Notice, the Specific Conditions for certain services and other notices, conditions of use and instructions made known to the User, as well as with generally accepted morality and good customs, and public order.
To this effect, the User will abstain from using any of the services to aims or effects which are illicit, prohibited in this Legal Notice, detrimental to the rights and interests of third parties, or which in any way may damage, disable, overload or prevent the normal usage of the services, IT equipment, or the documents, archives and any type of content stored in any IT equipment belonging to SEGITTUR or to other Internet Users (hardware and software).
The User also agrees to use the content made available to Users on the Web Portal, this meaning, and this list is non-exhaustive, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sonic content, as well as graphic design and fonts (hereinafter “Content”), in accordance with the law, this Legal Notice, the Specific Conditions for certain Services and other notices, conditions of use and instructions made known, as well as with morality and generally accepted good customs and public order.
– Analysis and/or verification mechanisms.
Some of the pages of the SEGITTUR portal have analysis and/or verification mechanisms –cookies– that are small data files generated on the user or client’s computer when he/she navigates the Portal’s sites and pages. The cookies that can be used at the sites and pages of the Portal are associated solely with the browser of a specific computer (an anonymous User), and do not in themselves provide names and surnames of Users. They allow our systems to remember the language and portal chosen, along with other navigation characteristics and preferences chosen by the user during his first session. These cookies are not invasive or harmful. Nor do they contain personal details – their only function is to personalise navigation options as previously expressed. The User has the option of configuring his/her browser to receive notice of receipt of cookies, and in order to prevent the installation of cookies on his/her hard disk. Users who so desire may disable and/or delete these cookies.
The cookies which are used at the sites and pages of the Portal may be served by SEGITTUR, in which case they are served from the various servers operated by SEGITTUR, or by the servers of specific third parties who provide SEGITTUR with services and serve cookies through TURESPAÑA (such as, for example, those used in order to serve specific content and which let the User view this content according to predetermined forms, times and number of occasions).
– Establishment of hyperlinks.
Users who intend to establish a hyperlink between their website and the SEGITTUR Portal should meet the following conditions:
a) There must be no confusion to other potential users about the origin and property of each of the websites.
b) The website in which the hyperlink is established must not contain any information or content that is false, inaccurate, illicit, illegal, immoral, or contrary to generally accepted customs or public order. Neither must it contain any content that is contrary to the rights of third parties.
c) Establishment of the hyperlink does not in any way imply the existence of relations between SEGITTUR and the owner of the website in which it is established. Neither does it in any way imply acceptance or approval of the content or services of said website, and there must, then, be no statement or implication to the effect that SEGITTUR authorises the hyperlink or supervises or assumes any of the services available via the website at which the hyperlink is established.
– Excluded guarantees and liability
1.- For the functioning, content and services of the Portal
SEGITTUR does not guarantee the availability and continuity of the functioning of the Portal, its services and content. Therefore, under no circumstances will it be responsible for harm or prejudice of any kind that could result from the lack of availability or continuity of the Portal or any of its services, or from failures in access to the different pages of the Portal or to those pages offering specific services.
SEGITTUR does not guarantee use of the Portal, its services or content, for carrying out any specific activity. Therefore, use of information, content and services is carried out under the sole and exclusive responsibility of the User.
SEGITTUR offers the content included in the Portal, with information from internal and external sources alike, in good faith. Due to this, and to the large amount of information made available to the User via the Portal, SEGITTUR cannot guarantee that this information is completely reliable, legal, exact and up to date, despite the best efforts to achieve this. Therefore it is free from all responsibility for damage and prejudice of any kind that could result from these circumstances; in the same way, SEGITTUR neither controls nor guarantees the absence of viruses or other elements in the content of the Portal, and in the services offered by third parties via the Portal, which could produce alterations in your IT system (software and hardware), or in electronic documents and files stored in your IT system, and is thereby excluded from any responsibility for damage or prejudice of any kind that could result from the presence of viruses or other damaging elements in those contents or services.
Under no circumstances will SEGITTUR be responsible, whether directly or indirectly, for any content, information, communication, opinion or manifestation of any kind communicated, broadcast, transmitted or exhibited via the Portal, which comes from an external source.
2.- For the information, content and services hosted outside the Portal
The Portal offers users technical link mechanisms, directories and search tools (such as, amongst others, links, banners, etc.), which allow access to web pages and sites belonging to and/or managed by third parties, with the aim of allowing Portal Users to search for and access information, content and services available on the Internet.
The results of technical link mechanisms, directories and search tools are provided directly by third parties, and are a consequence of the automatic functioning of technical systems. Therefore, SEGITTUR is not responsible for control and vigilance over their content and services, and assumes no responsibility, whether direct or indirect, for said web pages or sites, their content, services or transactions carried out via them. The User should be extremely prudent in the evaluation and use of information, content and services made available via these mechanisms.
3.- For the use that the users make of the Portal
SEGITTUR has no obligation and cannot control the use that made of the Portal, its services and contents by the users. Specifically, SEGITTUR does not guarantee that Users make use of the aforementioned in accordance with this Legal Notice, and should it be the case, with the Specific Conditions, notices, conditions of use and instructions resulting from application, nor that they do so legally and appropriately, and is not responsible in any way for damage or prejudice of any kind that could result from users’ illegal, incorrect, inappropriate or inadequate use of the Portal, its services or its content.
In the same way, SEGITTUR does not guarantee the privacy and security of use of the Portal and, especially, it does not guarantee that non-authorised third parties will not be able to gain knowledge of the type, conditions, characteristics and circumstances of use of the Web Portal made by Users’. Therefore it is not responsible for damages and prejudice of any kind that could result from this non-authorised access.
If any of these conditions were to be declared illegal, invalid or inapplicable due to a law in the State in which these conditions are applied, they will be considered void (to the extent and under the jurisdiction that these conditions become illegal, invalid or inapplicable); nevertheless, the remaining terms and conditions will continue in force and remain binding and enforceable.
